Effect of MUTCD on Tort Liability of Government Transportation Agencies

Overview

The purpose of this practice is to keep state highway departments and transportation agencies up-to-date on the laws and legal elements that will affect their operations. Specifically, this addresses 3 main issues: the effect of the Manual on Uniform Traffic Control Devices (MUTCD) on the development of government tort liability;  the extent to which federal, state, and other governments have adopted tort claims acts as laws and have waived or greatly curtailed sovereign immunity; and the impact of peculiar state laws.
